General terms and conditions of sale

These General Terms and Conditions of Sale (GTC) govern the sales of products made on the website www.sampain.com , published by Samir Z. , sole proprietor, under the trade name Sampain – Equipment to relieve postural pain .

1. Purpose

The purpose of these General Terms and Conditions is to define the rights and obligations of the parties within the framework of the online sale of products offered by the seller to the consumer customer.

2. Products

The products offered for sale are described and presented as accurately as possible.
Photographs are not contractual.

3. Price

Prices are shown in euros (€), including all taxes (TTC).
The seller reserves the right to change prices at any time, but products will be billed based on the price in effect at the time of the order.

4. Order

Any order placed on the site implies full and complete acceptance of these Terms and Conditions.
An order confirmation is sent by email after payment has been validated.

The seller reserves the right to cancel any order in case of payment problems or suspected fraud.

5. Payment

Payment is secure and can be made by credit card, PayPal, or any other method offered at the time of ordering .
Transactions are processed via payment providers that comply with security standards (Shopify Payments / PayPal).

6. Delivery

The products are shipped to the address provided by the customer when placing the order.
Delivery times vary depending on the carrier and are specified before payment confirmation.

In case of delay, an information email is sent to the customer.
The seller cannot be held responsible for a delay due to the carrier or an incomplete address.

7. Right of withdrawal

In accordance with Article L.221-18 of the Consumer Code, the customer has a period of 14 days from receipt of the product to exercise their right of withdrawal, without justification.

The product must be returned in its original and complete condition (packaging, accessories, instructions…).
Return shipping costs are the responsibility of the customer, except in the case of an error attributable to the seller.

8. Warranty

The products benefit from the legal guarantee of conformity and the guarantee against hidden defects provided for by the Civil Code.

9. Responsibility

The seller cannot be held responsible for damages resulting from misuse of the purchased product.
The seller cannot be held liable in the event of force majeure (strike, disaster, impossibility of transport, etc.).

11. Applicable Law

These terms and conditions are governed by French law.
In the event of a dispute, an amicable solution will be sought before any legal action is taken.
In the absence of an agreement, the French courts will have sole jurisdiction.

They are not medical devices as defined by current regulations and should not be used as such.
